By continuing with the registration process, you have read and agree to the Privacy Policy and Terms of Use.

Terms of Use/Service

You must be a White Birch Recreational Association real estate/property owner 18 years of age or older to register and access the Whitebirch.org/wblra Member Area. All posts made on behalf of a minor shall be placed by a Parent or Legal Guardian who is a current WBLRA Member/Property Owner. All posts made on behalf of a minor shall be the responsibility of the WBLRA Member/Property Owner who placed the ad.

WBLRA Member Area accounts ARE NOT transferable. Whitebirch.org reserves the right to remove access and close any Member and/or Associate Member account once the Member/s no longer own real estate/property within the association or for any violation of Terms of Use.

While registering, you agree to provide your legal name, true, accurate, current and complete information, as prompted by the Member Area registration process. NO REGISTRATIONS UNDER “ALIASES OR SCREEN NAMES” WILL BE PERMITTED. You agree to maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If any information provided is untrue, inaccurate, not current or incomplete, or Whitebirch.org has reason to believe such information is untrue, inaccurate, not current or incomplete, Whitebirch.org reserves the right to suspend or terminate the account and refuse any and all current or future use of the Member Area. Furthermore, you agree that all terminations for cause shall be made at the sole discretion of Whitebirch.org and that Whitebirch.org shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Member Area.

The Whitebirch.org/wblra Member Area provides registered users with access to various resources, including forms and information such as meeting minutes, income statements and audit reports. By accessing “Whitebirch.org/wblra”(hereinafter “we”, “us”, “our”, “whitebirch.org”, “http://whitebirch.org/wblra”, “Member Area”), you agree to be legally bound by the following terms. If you do not agree with the following terms, please do not register for access to the Whitebirch.org/wblra Member Area. We may occasionally change these terms and we’ll do our best to inform Members of those changes, but it would be well advised to review these terms regularly as your continued usage of the Member Area after changes, mean you agree to be legally bound to the updated and/or amended terms. In consideration of your use of the Member Area, you represent that you are of legal age to form a binding contract. You also agree not to access the Service by any means other than through the interface provided by Whitebirch.org for use in accessing the Member Area.

The Member Area is powered by SMF (hereinafter “they”, “them”, “their”, “SMF software”, “www.SimpleMachines.org”, “SMF Group”, “SMF Teams”) which is a bulletin board solution released under the “General Public License” (hereinafter “GPL”) and can be downloaded from http://www.SimpleMachines.org. For more information about SMF, please see: http://www.SimpleMachines.org. The SMF software only facilitates internet based discussions, the SMF Group is not responsible for what we meaning Whitebirch.org, allow and/or disallow as permissible content. You understand and agree that the Member Area is provided "AS-IS" and that Whitebirch.org assumes no responsibility for the SMF software or functions provided by the hosting service. This includes the timeliness of posts, deletions, mis-delivery or failure to store any user communications or personalization settings.

“Whitebirch.org” reserves the right to remove, move, edit, or close any topic at any time. As a user, you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, neither “Whitebirch.org” nor SMF shall be held responsible for any hacking attempt that may lead to the data or personal information being compromised. Whitebirch.org reserves the right to modify or discontinue, temporarily or permanently, the Member Area (or any part thereof) with or without notice. You agree that Whitebirch.org shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Member Area (or any part thereof).

You agree to indemnify and hold White Birch Lakes Recreational Association, Whitebirch.org, its officers, agents, employees, hosts, and volunteers maintaining the Member Area, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Service, or your violation of any rights of another.

You understand that all information ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not Whitebirch.org, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available on or through the Member Area. Whitebirch.org does not control the Content posted by users and does not guarantee the accuracy, integrity or quality of such Content.

Under no circumstances will whitebirch.org be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Member Area by any user or third party.

You further agree: (a) not upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable by these terms; (b) not harm minors in any way; (c) not impersonate any person or entity, including, but not limited to a whirebirch.org official, employee, Member Area administrator, host, or member, or falsely state or otherwise misrepresent your affiliation with a person or entity; (d) not forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Member Area; (e) not upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); (f) not upload, post, email, transmit or otherwise make available any Content (video, images, recordings, or content) that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party; (g) not upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except those permitted in areas (such as classified ads and real estate listings) that are designated for such purpose. (h) not upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (i) not interfere with or disrupt the Member Area or servers or networks connected to the Member Area, or disobey any requirements, procedures, policies or regulations of networks connected to the Member Area; (j) not provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act; (k) not "stalk" or otherwise harass another; and/or (l) not collect or store personal data about other users in connection with the prohibited conduct and activities stated in above paragraphs or post any other material that may violate any laws of your country, the country where “Whitebirch.org/wblra” is hosted or International Law. Doing so may lead to being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions.

The Member Area may provide, links to other World Wide Web sites or resources. Because Whitebirch.org has no control over such sites and resources, you acknowledge and agree that Whitebirch.org is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Whitebirch.org shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

You will receive a password and a user account once you complete the Member Area's registration process and your Member information is confirmed. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Whitebirch.org of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Whitebirch.org cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

Although a private gated community, White Birch Lakes Recreational Association is not responsible for monitoring, insuring or securing dwellings, property or the personal belongings of its members or their guests.  All properties within the Association are deeded and subject to land use restrictions. All persons acquiring property within the Association agree to abide by these restrictions as well as pay a yearly maintenance fee per eligible lot owned.
